These Terms of Service (“Terms”) govern your access to and use of TrekO.ai (the “Platform”), which is operated by WEB3 TREK, INC. (“we,” “us,” or “our”). By creating an account, accessing, or using TrekO.ai, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

TrekO.ai provides tools for users to list, display, buy, and sell physical items, artwork, digital collectibles, and NFTs. We are a platform provider only. Unless explicitly stated otherwise, we are not the buyer or seller in any transaction between users.
You agree to use the Platform only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.
Sellers are solely responsible for the accuracy of their listings, including titles, descriptions, prices, photos, and any applicable taxes or shipping information. Buyers are responsible for reviewing item details before making a purchase and for providing accurate payment and shipping information.
We may charge marketplace or service fees for certain transactions or features. Any such fees will be disclosed before you complete a transaction.
TrekO.ai uses third-party payment processors, including Stripe, to process certain payments on the Platform. By making or receiving payments through TrekO.ai, you also agree to be bound by the applicable Stripe Services Agreement and any other terms required by Stripe.

We do not control and are not responsible for Stripe’s performance, availability, or the decisions Stripe may make about your ability to use its services.
Sellers are responsible for shipping sold items to buyers using the shipping method selected at checkout (which may include rates provided through integrated services such as EasyPost or carriers like USPS or UPS).
Risk of loss passes from the seller to the buyer once the item is handed to the carrier, unless otherwise required by applicable law. TrekO.ai is not responsible for delays, damage, or loss caused by carriers or incorrect shipping information provided by users.
For digital assets and NFTs, you acknowledge that:
You are solely responsible for understanding the risks associated with digital assets and NFTs before participating in any related transaction.
You retain ownership of any content you upload to TrekO.ai, including images, artwork, descriptions, and listing information (“User Content”). By uploading User Content, you grant WEB3 TREK, INC. a non-exclusive, worldwide, royalty-free license to host, display, and use your User Content in connection with operating, promoting, and improving the Platform.
You represent and warrant that you have all necessary rights to upload and use the User Content and that your content does not infringe any third-party rights, including copyright, trademark, or privacy rights.

We make no guarantees regarding the quality, safety, legality, or fitness of any items listed by users, nor the conduct of buyers or sellers.
To the maximum extent permitted by law, WEB3 TREK, INC. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with:

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of TrekO.ai after any changes become effective constitutes your acceptance of the revised Terms.
We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or engaged in behavior that may harm the Platform, other users, or third parties.
You may stop using the Platform and close your account at any time. Certain provisions of these Terms will continue to apply after termination, including those relating to payments, intellectual property, limitations of liability, and indemnification.
These Terms are governed by the laws of the State of Montana, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of TrekO.ai will be resolved in the courts or through arbitration venues located in Montana, unless applicable law requires otherwise.
